The Supreme Court, while hearing a case of rape in Rajasthan, compared the suffering of a rape victim to an epidemic. The Supreme Court observed that the pandemic had started long before the time the accused had done to his daughter and left no mercy for her father. The father was ordered by the trial court to remain in jail till the evidence of the girl and other witnesses were recorded.
The Supreme Court was hearing a petition challenging the bail granted to her father by a girl above 16 years of age on September 3, 2020. In fact, the girl had accused her father of raping a man named Prince, who worked as a government employee in Rajasthan. The first time this happened to her was when she was in fourth grade. This continued for six years until she gathered courage and filed a police complaint in April 2020, which led to the registration of a case against her father for rape (Section 376) of the Indian Penal Code (IPC) and under the POCSO Act. had gone.
Seeing the possibility of going to jail again, the father urged the court to consider the present COVID-19 pandemic which may pose a risk to his life in jail. The father pleaded with the court and said that he would fully cooperate in the matter but let him stay outside.
A Bench of Justices Sanjay Kishan Kaul and Hrishikesh Roy while commenting on the plea of the father said that according to what you have done to him, the epidemic started long back for him. In front of the court, the father also narrated a story to prove himself innocence. The father said that in fact his daughter had a relationship with a boy of other religion, he was against it and protested. The Supreme Court asked the state to verify whether this fact was stated by the person in the past during the investigation.
The state police told the court that the story told by the accused was never reported to the police. The father claimed that he had given his daughter martial arts training. In such a situation, a brave girl will never bear this pain silently for so many years. The court set aside the pleas of the father and canceled the bail till the prosecution witnesses are examined. The medical examination of the victim has confirmed rape.
