Screw stuck in registration of 40 year old marriage, Delhi HC seeks reply from government

The Delhi High Court on Thursday sought response from the Delhi government on a plea by a couple, who were married 40 years ago. The couple is complaining that they are unable to register their marriage online as the software is not accepting their application for being underage at the time of marriage in 1981.

Justice Rekha Palli has issued notices to the authorities and the SDM of Alipore and the District Magistrate of North West Delhi to respond to the petition. The petition has sought to register the marriage of the couple within two weeks. The next hearing on the matter will take place on December 23.

The petition states that the couple approached the SDM, Alipore to register their marriage with all relevant documents, but this could not happen as the software did not accept their application for the same reason. When they got married on 28 May 1981, the age of the man was below 21 years and the age of the woman was less than 18 years.

Advocate JS Mann, representing the couple, submitted that they fulfill all the conditions for registration of marriage under the law as they have completed 21 years of age at the time of registration and their marriage took place in May 1981 as per Hindu Vedic rites. Had happened.

The petition states that from the date of marriage they are leading their family life as husband and wife and have four children. The petition states that the authorities have neither rectified the software nor registered their marriage in any other way so far. He has termed it as unjust, arbitrary and illegal due to violation of fundamental rights and non-compliance of law.
